Fratter PTY LTD t/a Fratter Photography
1. Agreement
By engaging Fratter PTY LTD t/a Fratter Photography for real estate photography, floor plans, virtual staging, drone services, or any other offerings, you (the client) agree to the following Terms and Conditions. This constitutes a legal agreement between the client and Fratter Photography (Wilma Fratter Photography t/a Fratter PTY LTD).
2. Copyright & Image Rights

Copyright Ownership: All images and creative files remain the sole property of Fratter PTY LTD t/a Fratter Photography.

Usage Rights: A limited, non-transferable licence is granted to the paying client for the duration of the property listing. This licence allows use of images in marketing the listed property and the client’s brand.

Third-Party Use: This licence does not extend to third parties such as builders, stagers, architects, other agents, publications, designers, or buyers/sellers. A third-party usage fee starting at $175 applies and must be paid prior to use. The property owner may retain copies for personal (non-commercial) use.

Publications: For trade or print publication use, written permission is required, and full credit must be given to Fratter Photography.
3. Bookings

All bookings will be confirmed via email. Please ensure address and time details are accurate.

Fratter Photography reserves the right to upgrade your shoot as needed to ensure marketing quality. Additional shots or services may incur extra costs.
4. On-Site Requirements

The agent or their representative must be present unless otherwise agreed.

Properties must be “photography ready” upon arrival — clean, tidy, and styled as desired.

Fratter Photography does not move, stage, or tidy items on-site.

Fratter Photography is not responsible for the appearance of unprepared areas.

Key handling is no longer provided. An agent or vendor must meet the photographer and remain until the shoot is complete.

Scheduled shoot times are exclusive. No other appointments or trades (e.g. cleaners, pest inspectors, open homes) should coincide with our booking time.

Any delays or over-time due to unprepared properties may require rescheduling or incur additional charges.
5. Delivery of Images, Videos, and Files

Photography and floor plan files are typically delivered by the end of the next business day, depending on current workload and scheduling.

Video content (including walk-throughs and drone footage) may require up to 3 business days for delivery due to editing and production demands.

Clients will receive two sets of images:

High-resolution for print use

Web-optimised for online platforms (e.g. realestate.com.au)

All final files are produced using colour-calibrated monitors for professional print accuracy. Please note that colours and sharpness may vary when viewed on non-calibrated screens or in basic applications.

For optimal print results, we recommend using a professional photo lab.
6. Drone Photography

Drone use is strictly compliant with CASA regulations and will not be performed in no-fly zones.

We use resources such as ok2fly.com.au and OpenSky to assess flight eligibility. However, drone shoots cannot be guaranteed until the day of the appointment.

If drone usage is not possible on-site due to restrictions, we reserve the right to modify or cancel that portion of the service.

Neighbour Disputes: Any neighbour disputes arising from drone operations must be handled by the responsible agent. Contact details of the agent will be shared with concerned parties if necessary.
7. Floor Plans

Floor plans are artistic representations and approximate only.

The agent and vendor must review plans for accuracy. One round of minor changes is included; subsequent revisions are charged at $25 per change.

Fratter Photography is not liable for any misstatements or approximations depicted in floor plans.
8. Cancellations & Access Issues

Cancellations made within 24 hours of the scheduled shoot will incur a 50% fee of the booking value.

If access to the property is not possible at the scheduled time, a 50% cancellation fee will apply.
9. Furniture Removal & Photoshop Requests

For image edits involving item removal, please note:

We cannot always predict or recreate what lies beneath large items (e.g. rugs, furniture).
-
We will do our best to match textures and surfaces, but cannot guarantee perfection.
-
Complex edits may require additional time or incur extra fees.
10. Payment Terms
We appreciate your prompt payment and have outlined the following terms for clarity:

Invoices are issued by the next business day following your scheduled shoot.

Payment is due within 7 calendar days from the date of the invoice.
-
First-time clients must pay in full prior to the release of any images or content.
-
Invoices that remain unpaid for more than 30 days may incur a late payment fee.

In the event of a duplicate payment, no refunds will be issued. Instead, the overpaid amount will be retained as a credit on your account for future bookings.

Invoices that remain unpaid for more than 30 days will incur a $15 late payment fee.

The person or entity who makes the booking is fully responsible for payment of the invoice, regardless of whether they are the direct end-user of the content or acting on behalf of another party (e.g. vendor, builder, or agency).
All payment details and methods are clearly provided on each invoice. Please contact us if you need to make alternate arrangements in advance.
11. Final Note
Fratter Photography strives to provide exceptional service while maintaining clear communication and fair expectations. By continuing with our services, you acknowledge and agree to all terms above.
