Real Estate Terms and Conditions
By hiring Fratter PTY Ltd t/a Fratter Photography for photography, floorplan, or drone services you are bound by the following terms and conditions. This constitutes a legal agreement between yourself and Wilma Fratter Photography t/a Fratter PTY LTD

Copyright/Image Retention
All images and files remain the copyrighted property of Fratter PTY Ltd t/a Fratter Photography. We reserve the right to use and publish images for our advertising and in industry competitions.
Photo Usage Rights
Limited usage rights are transferred to the paying client for the duration of the property listing. This is an individual and non-transferable license that allows the use of the images for all marketing material and campaigns associated with promoting the specific property and the agent, for the duration of the listing.
This license is only granted to the paying client and not to any third party, including but not limited to builders, architects, staging professionals, other real estate agents, designers, publications, buyers, or sellers. Use of the images by such third parties requires written permission from Fratter PTY Ltd t/a Fratter Photography. An exception to the third party is the homeowner, who may retain a copy of the images for personal, but not commercial, use.
We charge a third-party fee of a minimum of $175 for the use of our work, to be paid before third-party use for marketing of the relevant property.
If images are to be published in any sort of trade publication, written permission needs to be sought from Fratter PTY Ltd t/a Fratter Photography, and full credit to Fratter PTY Ltd t/a Fratter Photography is required.

Bookings
Fratter PTY Ltd, trading as Fratter Photography, will confirm all bookings before the scheduled appointment. Upon making a booking, you will receive a confirmation email. Please ensure that the address is accurate and matches the scheduled shooting time.

Please be advised that we reserve the right to upgrade your photoshoot at any time, as deemed necessary for marketing purposes and to showcase your property in the best possible light. These upgrades may include additional shots and costs.
The Photo Shoot
The client or their representative must be at the shoot unless previously arranged.
The property is to be ready for photography when we arrive, which means it is.
Tidy and furniture are in the desired position and relevant items are put away of which the
AGENT, CLIENT, AND VENDOR do not want to be photographed. If the property
requires time to get it “photography ready” then we suggest the agent gets to the
property before us to ensure the property is ready before our arrival at the property or
that bookings are made giving a reasonable time for the property to be ready for
photography. Fratter Photography is not responsible for moving/removing items within or on the property nor styling or staging of the property. This is solely the agent’s and property owner’s responsibility, and Fratter Photography will not be held responsible or liable for images taken of items/rooms/areas that have not been prepared to the owner’s or agent’s satisfaction prior to our arrival or during the photographic shoot. Our photographers use the time Fratter Photography has allocated for the photography to take photos and not to prepare or tidy the relevant areas being photographed.
Fratter Photography has implemented a new policy. We will no longer be responsible for key handling. Instead, the agent or vendor is required to meet the photographer on-site and remain present until the photoshoot is completed.
Once a booking is confirmed the time allotment. i.e 1pm-2pm is for exclusive access by Fratter Photography at no time should other activities be scheduled during shoot time i.e. cleaners, handymen, painters, building & pest, inspections, or open homes. We need full access to the entire residents without distractions or excessive waiting periods. We allow to be onsite for the exact time period i.e. 1hr for a photoshoot and no longer, extending this allotted time will disrupt our entire day and will not be tolerated. If additional time is needed on site a new booking will need to be made or a prior agreement needs to be reached in writing.
Delivery
Due to fluctuations in workload and deadlines, Fratter PTY Ltd t/a Fratter Photography reserves the right to extend delivery times.

Images and floor plans are delivered by the end of the next business day via digital download.
There are two sets of images, one high res for print purposes, one web for internet use.
Low-resolution images are sized at 2000 x 2000 pixels, the required size for real estate .com .au. High-resolution images are full-size. (2.5-4MB)
Floorplans are similarly provided in two formats - a low-resolution .jpeg for the internet, and a high-resolution .jpeg for printing.
Please note that all images produced by Fratter PTY Ltd t/a Fratter Photography have been done with the use of colour-calibrated monitors. Monitors used by the Photographer have been calibrated to meet printing standards, thus colour changes may occur when images are viewed on non-calibrated monitors. Also, note that images viewed in non-professional editing programs will appear less sharp than if the same images are viewed using a professional program. Printed images will be correct in colour, sharpness, and other variables that may be affected by the non-calibrated monitor and non-professional programs, that is, if the printed images have been produced by a professional imaging lab. For printed images to meet the quality of the original digital files, they must be printed on high-quality photographic paper or on other professional photographic mediums and done so by a professional lab. It is highly recommended that the Client order printed images from a reputable, professional lab to ensure that the quality of his or her digital images is met. Fratter PTY Ltd t/a Fratter Photography is not liable for the quality of images printed by any imaging lab, both professional and non-professional.
Drone Photography
With the increasing demand for drone photography on the Sunshine Coast, we all must be familiar with the rules so we can keep everyone safe on the ground and in the air.
Fratter PTY Ltd t/a Fratter Photography does not fly in no-fly zones and will adhere to all CASA rules and regulations.
Here are some of the websites you can use to check to see whether we can fly a drone at the property or not.

Open Sky
Although we try to verify and ensure it's safe to fly before accepting bookings, there may be occasions when we don't check it and arrive at the shoot not knowing we couldn't fly there. Thus, we can't guarantee drone images but will try our best.
Fully licensed RePL drone operators are NOT ALLOWED TO FLY IN NO FLY ZONES
ANGRY NEIGHBOUR TERMS
We would like to emphasize that any form of neighborly dispute or abuse related to drone photography will not be tolerated at my shoot. We aim to ensure a peaceful and harmonious living environment for everyone.
In the event of a dispute with a neighbor regarding drone photography, the contact details of the responsible agent will be provided to all parties involved. It will be the agent's responsibility to handle and mediate the situation, working toward an amicable resolution.
Floor Plans
A real Estate agent needs to ensure that you and your vendor/owner have checked your plan. Please let me know if there are any amendments necessary before proceeding with advertising. The first request for minor changes is of no charge, subsequent requests are charged at $25.

This plan is for illustrative purposes only and should only be used as such by any prospective purchaser.

Cancellations
Cancellations within 24 hours of the shoot will incur a 50% OF THE BOOKING VALUE charge.
If a property is unattended at arrival where access is not possible, a cancellation fee will be charged at 50% of the total booking value.
Payment

The invoice will be processed and will be sent to you the next business day. Your invoice is due in 7 days.
Invoice more than 30 days overdue will incur a late payment fee.
First-time users are required to settle their invoices before receipt of images.
Furniture Removal/PHOTOSHOP Terms
Please Note: For some images, there is no way for us to know what is behind items that are being removed. Also, if items cover a large area (e.g. a large rug covering the floor) then we may need to re-draw the whole surface. We will do our best, but cannot guarantee, to match the existing surface style/pattern.
